NOTICE TO BIDDERS

Pursuant to the provisions of the General Municipal Law, Thomas Widrick, Superintendent of Highways for the Town of Lowville, Lewis County, NY hereby invites sealed bids to purchase 1 – used Gradall.  Specifics available at the office of the Town Clerk, 5533 Bostwick St., Lowville, NY.

Bids will be received at the Town Clerk’s Office until 4:00 pm on November 16, 2021.  Bids will be opened at 10:00 am on November 18, 2021 at the Town Municipal Office Building.  Please write “sealed bid” on outside of envelope.  The Town Board reserves the right to reject any or all bids.

Public Hearing notice – Local Law #2-2021

NOTICE OF PUBLIC HEARING

TOWN OF LOWVILLE                  

                        PLEASE TAKE NOTICE that the Town Board of the Town of Lowville will hold a public hearing on the 21st day of October, 2021 at 10:00 AM at the Town Hall located at 5533 Bostwick Street, Lowville, New York.  The subject of the hearing is a proposed Local Law entitled “A Local Law opting out of the Enforcement and Administration of the New York State Uniform Building and Fire Code pursuant to Section 381 of the New York State Executive Law.”  If enacted, such Local Law would result in the County of Lewis assuming such enforcement and administration of the Uniform Building and Fire Code.  A draft copy of the proposed Local Law is available for inspection and/or copying at the Office of the Town Clerk during regular business hours.

Certificate of No Referendum – New F350 Dually Truck

CERTIFICATE OF NO REFERENDUM

The undersigned is the duly appointed and acting Town Clerk of Lowville.  On August 19, 2021, the Town of Lowville Town Board adopted a resolution authorizing the expenditure of funds from the Highway Equipment Reserve Fund.  On September 1,2021, notice of the adoption of such resolution with an abstract of its terms and notice that such resolution is subject to a permissive referendum was published in the official newspaper of the Town of Lowville.  I hereby certify that more that thirty days has passed since the adoption of such resolution and no petition for a permissive referendum has been filed in my office.

Certificate of No Referendum: Local Law #1-2021

 NOTICE OF NO REFERENDUM

 Please take notice on June 17, 2021, the Town Board of the Town of Lowville adopted a local law opting out of the provisions of the New York State Cannabis law which would otherwise authorize retail dispensaries and onsite consumption sites within the Town of Lowville.  This Local Law would effectively prohibit the location of retail dispensaries and onsite consumption sites within the jurisdiction of the Town of Lowville.

Pursuant to the terms of the Cannabis Law, such opt out Local Law is subject to a permissive referendum under the terms of Section 24 of the Municipal Home Rule Law.  On the 29th day of June, 2021, a notice of the adoption of the proposed Local Law together with an abstract thereof and a notification that the local law was subject to permissive referendum was published in the official newspaper of the Town of Lowville and posted on the Town Clerk’s board.

I hereby certify that more than 45 days have now passed since the adoption of such Local Law, and I have not received a petition calling for a permissive referendum.

Expenditure of Highway Reserve Funds Subject to Permissive Referendum

PLEASE TAKE NOTICE that  at a Town Board meeting held August 19, 2021, the Town of Lowville Town Board adopted a resolution authorizing the expenditure of up to fifty-eight thousand, three hundred twenty-five dollars ($58,325.00) from the Highway Equipment Reserve Fund for the purpose of purchasing a new Ford F350 regular cab, dually with dump box and plow.  This resolution is subject to permissive referendum.

NOTICE OF FILING OF COMPLETED FINAL ASSESSMENT ROLL WITH TOWN CLERK

Pursuant to Section 516 of the Real Property Tax Law

 

NOTICE is hereby given that the Assessment Roll for the Town of Lowville in the County of Lewis and State of New York for the year 2021, has been finally completed and verified by the undersigned assessor, and a certified copy thereof will be filed in the Office of the Town Clerk of said Town, on the 1st day of July, 2021, where the same will remain open to public inpsection.

Local Law #1-2021 Opting out of Cannabis retail dispensaries and on-site consumption sites

Local Law No.1 of the year 2021

Town of Lowville, County of Lewis

A local law to opt out of allowing cannabis retail dispensaries and on-site consumption sites as authorized under Cannabis Law Article 4

Section 1. Legislative Intent

It is the intent of this local law to opt out of allowing cannabis retail dispensaries and on-site cannabis consumption sites in the Town of Lowville that would otherwise be allowed under Cannabis Law Article 4.

Section 2.  Authority

This local law is adopted pursuant to Cannabis Law § 131 which expressly authorizes the town board to adopt a local law requesting the Cannabis Control Board to prohibit the establishment of cannabis retail dispensary licenses and on-site consumption licenses within the jurisdiction of the Town and is subject to a permissive referendum, the procedure of which is governed by Municipal Home Rule Law § 24.

Section 3.  Local Opt-Out

The Town Board of the Town of Lowville hereby opts out of allowing cannabis retail dispensaries and on-site cannabis consumption sites from being established and operated within the Town’s jurisdiction.

Section 4.  Severability.

If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person, firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.

Section 5.  Permissive Referendum/Referendum on Petition

This local law is subject to a referendum on petition in accordance with Cannabis Law § 131 and the procedure outlined in Municipal Home Rule Law § 24.

Section 5.  Effective date.

This local law shall take effect immediately upon filing with the Secretary of State.

Notice is hereby given that as of May 1, 2021, the Assessor(s) of the Town of Lowville , County of Lewis, have completed the Tentative Assessment Roll for the current year, and that a copy has been left at Town Clerk’s Office where it may be seen and examined by any interested person until Grievance Day. The tentative assessment roll is also available for viewing on the town’s website – www.lowville.racog.org or the Lewis County website- www.lewiscounty.org per requirement of RPTL section 1590(2)

The assessor(s) will be in attendance with the Tentative Assessment Roll at the
Lowville Town Offices, 5533 Bostwick St, Lowville on the following days:

Tuesday, May 4            11am-3pm; by appointment only

Grievance Day may or may not be held as usual depending on State mandated restrictions. At the very least the Board of Assessment Review will receive all complaints with written material. Please stay safe.

The Board of Assessment Review will meet on May 27, 2021 at the following times:

4 pm to 8 pm

at the Lowville Town Offices, 5533 Bostwick St, Lowville, in said town, to hear and examine all complaints in relation to assessments on the application of any persons believing him/herself to be aggrieved.
