Certificate of No Referendum: Local Law #1-2021
NOTICE OF NO REFERENDUM
Please take notice on June 17, 2021, the Town Board of the Town of Lowville adopted a local law opting out of the provisions of the New York State Cannabis law which would otherwise authorize retail dispensaries and onsite consumption sites within the Town of Lowville. This Local Law would effectively prohibit the location of retail dispensaries and onsite consumption sites within the jurisdiction of the Town of Lowville.
Pursuant to the terms of the Cannabis Law, such opt out Local Law is subject to a permissive referendum under the terms of Section 24 of the Municipal Home Rule Law. On the 29th day of June, 2021, a notice of the adoption of the proposed Local Law together with an abstract thereof and a notification that the local law was subject to permissive referendum was published in the official newspaper of the Town of Lowville and posted on the Town Clerk’s board.
I hereby certify that more than 45 days have now passed since the adoption of such Local Law, and I have not received a petition calling for a permissive referendum.
